Terms and Conditions

of Theodor Kubička, with place of business at Šlikova 16, 169 00 Praha, Czechia, operating the online store CRUX Climbing Studio (the "Seller"), for the sale of goods through the online interface located at cruxclimbingstudio.com (the "Store").

These Terms and Conditions (the "Terms") govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (the "Civil Code"), the mutual rights and obligations of the Seller and any natural person (the "Buyer") arising in connection with or pursuant to a purchase contract (the "Contract") concluded between the Seller and the Buyer through the Store.

  1. Introductory Provisions

1.1. These Terms form an integral part of every Contract. Deviating provisions agreed in writing in the Contract prevail over these Terms.

1.2. These Terms apply to Buyers who are consumers within the meaning of Section 419 of the Civil Code. Provisions specific to consumer protection do not apply to Buyers acting in the course of their trade or business.

1.3. The Seller may amend these Terms. The version applicable to a given Contract is the one in force at the moment the order is placed. Amendments do not affect rights and obligations arising while an earlier version was in force.

1.4. The Store is hosted on the Shopify platform operated by Shopify Inc., which provides the online e-commerce infrastructure through which the Seller sells its goods.

  1. Use of the Store

2.1. By accessing or using the Store the Buyer confirms that they have reached the age of majority in their country of residence, or that they are using the Store with the consent of their legal guardian.

2.2. The Buyer must not use the Store for any unlawful purpose, must not attempt to interfere with or circumvent its security features, and must not upload or transmit any virus, worm or other harmful code.

2.3. The Buyer must not scrape, crawl, spider or otherwise systematically extract content from the Store, collect or track the personal data of other users, submit false or misleading information, or use the Store to harass, abuse, defame or discriminate against any person.

2.4. The Seller may restrict or terminate access to the Store for any Buyer who breaches this Article 2.

  1. Ordering and Conclusion of the Contract

3.1. Orders are placed through the Store's website. The product listing in the Store is informative; the Seller is not obliged to conclude a Contract in respect of any listed item.

3.2. Before sending an order, the Buyer is able to check and change the data entered. The Buyer sends the order by completing checkout and confirming the order.

3.3. The Contract is concluded at the moment the Seller confirms acceptance of the order by email to the address provided by the Buyer. Automated order-receipt messages do not constitute acceptance.

3.4. The Buyer agrees to the use of remote means of communication for concluding the Contract. Any costs incurred by the Buyer in this respect (internet, telephone) are borne by the Buyer and do not differ from the standard rate.

3.5. The Seller reserves the right to refuse or cancel an order, in particular where the goods are no longer available, where the price or product description contained an obvious error, or where the order appears to be placed by a dealer, reseller or distributor. If the Buyer has already paid, the Seller refunds the full amount without undue delay.

  1. Price and Payment

4.1. Prices are stated in euro (EUR) and remain valid for as long as they are displayed in the Store.

4.2. Shipping, packaging and any additional fees are stated in the order summary before the order is sent.

4.3. Accepted payment methods are payment card and digital wallets (Apple Pay, Google Pay, Shop Pay), processed via Shopify Payments. The purchase price is payable in advance unless otherwise agreed. In the case of non-cash payment, the price is considered paid upon credit to the Seller's account.

4.4. The Seller issues a receipt to the Buyer after payment and sends it electronically to the Buyer's email address.

  1. Delivery

5.1. Goods are delivered via the carrier shown at checkout. The Seller ships within two (2) weeks of receipt of payment, unless a different period is stated on the product page for pre-order or limited-release items.

5.2. The Seller delivers worldwide. Available destinations and shipping rates are shown at checkout before the order is sent.

5.3. The Buyer is responsible for any customs duties, import taxes or handling charges levied by the destination country. These are not included in the price shown at checkout unless expressly stated.

5.4. Risk of damage to the goods passes to the Buyer upon takeover of the goods. Where the Buyer is a consumer and the carrier was chosen by the Seller, risk passes at the moment the goods are handed over to the Buyer.

5.5. The Buyer is obliged to inspect the goods upon delivery and to notify the carrier of any visible damage to the packaging.

  1. Right of Withdrawal (Consumers)

6.1. In accordance with Section 1829 of the Civil Code, a consumer has the right to withdraw from the Contract within fourteen (14) days of the day on which the consumer, or a third party designated by the consumer, takes physical possession of the goods. No reason need be given.

6.2. To exercise this right, the Buyer must send an unambiguous statement of withdrawal to cruxclimbingstudio@gmail.com before the deadline expires.

6.3. The Buyer returns the goods to the Seller without undue delay, and no later than fourteen (14) days after communicating the withdrawal, to Šlikova 16, 169 00 Praha, Czechia. The Buyer bears the direct cost of returning the goods.

6.4. The goods must be returned undamaged, unworn, unwashed, with all original tags and packaging. The Buyer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

6.5. The Seller refunds all payments received from the Buyer, including standard delivery costs, without undue delay and no later than fourteen (14) days after receipt of the withdrawal. The Seller is entitled to withhold the refund until the goods are returned, or until the Buyer provides proof of return, whichever occurs earlier. The refund is made in money, using the same means of payment used by the Buyer, unless the Buyer expressly agrees otherwise. Where the Buyer chose a delivery method more expensive than the cheapest standard method offered by the Seller, the Seller refunds the cost of the cheapest standard method.

6.6. The right of withdrawal does not apply to goods manufactured or adjusted to the Buyer's wishes, or to goods that have been unsealed and cannot be returned for hygiene reasons once unsealed.

6.7. In addition to the statutory right above, the Seller may offer exchanges or store credit as a voluntary service. Nothing in any such offer limits the Buyer's statutory right under Article 6.1 to a refund in money.

  1. Rights from Defective Performance

7.1. The Seller is liable to the consumer Buyer for defects in accordance with Sections 2099 et seq. and 2161 et seq. of the Civil Code. The consumer Buyer is entitled to exercise rights from defective performance that appear in the goods within twenty-four (24) months of receipt.

7.2. A defect does not include ordinary wear and tear, damage caused by improper use, care inconsistent with the care label, or mechanical damage caused by the Buyer.

7.3. Complaints are submitted to cruxclimbingstudio@gmail.com, together with the goods, proof of purchase, and a description of the defect. The Seller decides on the complaint without undue delay, and in complex cases within three (3) business days. The complaint, including remedy of the defect, will be handled within thirty (30) days unless a longer period is agreed with the consumer.

7.4. Where a defect is established, the consumer Buyer may require repair or replacement; where that is disproportionate or is not carried out in time, the Buyer may require a reasonable discount or withdraw from the Contract.

  1. Product Information, Availability and Errors

8.1. The Seller has made every effort to display the colours, materials and dimensions of the goods as accurately as possible. The Seller cannot guarantee that the Buyer's screen will render colours accurately. Minor variation in shade, measurement and finish is inherent to garment-dyed, small-batch production and does not constitute a defect.

8.2. Goods are produced in limited quantities. The Seller may limit the quantity available per person or per order, and may discontinue any product at any time.

8.3. The Store may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, transit times or availability. The Seller reserves the right to correct such errors and to cancel affected orders, including after an order has been submitted, with a full refund of any amount already paid.

  1. Product Use and Care

9.1. The goods are garments intended for general wear and for recreational climbing. They are not personal protective equipment and must not be relied upon for safety purposes.

9.2. Fibre composition and care instructions are stated on the product page and on the garment label. Damage resulting from care inconsistent with those instructions is not a defect.

  1. Intellectual Property

10.1. All content of the Store, including text, graphics, logos, product imagery, the "CRUX" and "CRUX Climbing Studio" marks, garment designs and any editorial content, is the property of the Seller or is used with permission.

10.2. None of it may be copied, reproduced, distributed, resold or otherwise used without the prior written consent of the Seller, except for personal, non-commercial viewing of the Store.

  1. User Submissions

11.1. If the Buyer sends the Seller ideas, suggestions, photographs, reviews or other materials ("submissions"), whether requested or not, the Seller may edit, copy, publish, distribute, translate and otherwise use them in any medium without restriction and without compensation.

11.2. The Buyer confirms that their submissions do not infringe the rights of any third party and are not unlawful, abusive, defamatory or obscene. The Seller may, but is not obliged to, remove any submission.

  1. Third-Party Links and Services

12.1. The Store may link to third-party websites or incorporate third-party services and tools. These are provided as they stand, without warranty, and the Seller has no control over their content or practices.

12.2. The Seller is not liable for any loss arising from the Buyer's use of, or transactions with, third parties. The Buyer should review the terms and privacy practices of any third party before engaging with them.

  1. Limitation of Liability

13.1. The Seller does not warrant that the Store will be available uninterrupted, timely, secure or error-free, and may suspend or discontinue the Store or any part of it at any time.

13.2. To the extent permitted by law, the Seller is not liable for indirect or consequential loss, lost profit, lost data or loss of opportunity arising from the use of or inability to use the Store.

13.3. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for defects in goods sold to consumers, liability for damage caused intentionally or by gross negligence, and liability for damage to a person's natural rights. The limitations in Articles 13.1 and 13.2 apply to Buyers who are not consumers.

  1. Personal Data

14.1. The Seller processes the Buyer's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll. Details on the scope, purpose, legal basis, retention period and the Buyer's rights are set out in the Privacy Policy at https://cruxclimbingstudio.com/policies/privacy-policy.

  1. Out-of-Court Resolution of Disputes

15.1. The consumer Buyer is entitled to seek out-of-court resolution of consumer disputes through the Czech Trade Inspection Authority (Česká obchodní inspekce, Štěpánská 567/15, 120 00 Praha 2, www.coi.cz, online form at adr.coi.cz).

15.2. For cross-border disputes within the European Union, the Buyer may also contact the European Consumer Centre Czech Republic at www.evropskyspotrebitel.cz.

  1. Changes to These Terms

16.1. The current version of these Terms is always available in the Store. The Seller may update them by posting a revised version. The version in force at the moment an order is placed governs that order.

  1. Final Provisions

17.1. The Contract and these Terms are governed by the law of the Czech Republic. This choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence.

17.2. Disputes arising from the Contract fall within the jurisdiction of the Czech courts, without prejudice to a consumer's right to bring proceedings in the courts of their country of residence.

17.3. If any provision of these Terms is or becomes invalid or ineffective, it is replaced by a provision whose meaning comes as close as possible to the invalid provision. The invalidity of one provision does not affect the validity of the remaining provisions.

17.4. These Terms are effective from 16 September 2026.
